Welcome to the Laduma Hardware website ("Website"). These Terms and Conditions ("Terms") govern your use of our Website and the purchase of any products ("Products") or services ("Services") from Laduma Hardware and Bricks Pty Ltd.

By accessing the Website or registering an account, you acknowledge that you have read, understood, and agree to be bound by these Terms.

You warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are acting on behalf of a company or other juristic entity, you confirm that you have the authority to bind that entity.

• You must register an account to purchase products from our website.
• You are responsible for maintaining the confidentiality of your login credentials.
• We are not liable for losses resulting from unauthorized use of your account.
• You agree to provide accurate and complete information during registration.
• We reserve the right to verify your identity at any time.

4. PRODUCT IMAGES AND DESCRIPTIONS

• Visual Representation: Product images are displayed as accurately as possible, but actual products may differ slightly.
• Priority of Description: The written product description and model number take precedence over images.
• Ancillary Items: Images may include accessories or tools sold separately unless otherwise specified.

5. PRICING & INADVERTENT ERRORS

• VAT: All prices include 15% Value-Added Tax.
• Regional Pricing: Website prices apply to online purchases only and may differ from physical store prices.
• Pricing Errors: If a pricing mistake occurs, we will notify you and provide the option to cancel or continue at the correct price.

6. CONFIRMATION OF SALE

• An order placed on the website constitutes an offer to purchase.
• A binding agreement only occurs once payment has been received and products have been delivered or collected.
• Automated order confirmation emails do not constitute acceptance of your order.

7. PAYMENT METHODS

• Payments are accepted through PayFast (Visa / Mastercard) and Instant EFT.
• EFT orders will only be released once funds are cleared in our bank account.

8. DELIVERY CONDITIONS

• Pavement Delivery: Deliveries are made to the main entrance or pavement.
• Interior Access: If drivers enter your property, it is done at your request and risk.
• Vehicle Access: Delivery locations must be accessible to heavy vehicles.
• Multiple Dispatches: Large orders may arrive in separate vehicles.

9. STORE PICKUP (CLICK & COLLECT)

• Orders may be collected from selected Laduma stores.
• Valid ID and order confirmation must be presented.
• Orders not collected within 30 days may be cancelled with a possible storage or administration fee deducted.

10. RETURNS, REFUNDS & CANCELLATIONS

• Cancellations: Orders can be cancelled before dispatch by calling +27 13 758 2414.
• Cooling-Off Period: Under the ECT Act, customers have 7 days to return unused goods purchased online.
• Return Costs: Return shipping costs are the responsibility of the customer.

Exclusions include:

• Custom mixed paint
• Timber or boards cut to size
• Opened sealed goods such as cement bags

If a product is defective within six months, we will repair, replace, or refund the product in accordance with the Consumer Protection Act.

11. PRODUCT REVIEWS

By posting a product review, you grant Laduma Hardware a royalty-free and perpetual license to use the content for marketing purposes. We reserve the right to edit or remove reviews that are offensive, defamatory, or contain personal contact details.

12. LIMITATION OF LIABILITY

• The website is provided on an "as is" basis without guarantees of uninterrupted service.
• Laduma Hardware is not liable for indirect losses such as loss of profit or construction delays.
